Abstract

Victim of sexual crimes against children unprotected by the state; their survival and development are destroyed by being victims of sexual crime. Ultimately, they experience a second attack when the state is unable to help them by fulfilling their rights as victims. Legal protection must be implemented through an approach oriented towards humanitarian values, cultural identity values, and religion moral values (humanist, cultural, and religious), integrated with a rational, policy-oriented approach. Legal protection for the rights of child vicyims is an inevitability awaited by this nation’s generations, who to this day still believe this country is their homeland. Just as citizens protect their human rights, protecting children, particularly children who are victims of sexual crimes, is the state’s responsibility. This responsibility is implemented through various regulations and law enforcement that prioritize the best interest of children. The implementation of the rule of law will impact the welfare of society. The welfare of the state must be based on laws that can bring happiness to its people. In other words, the law must be based on benefits for uman happiness. According to Bentham, happiness from the law can be achieved if individuals are givenmaximum freedom to pursue what is good for them.
