EFEKTIVITAS UNDANG-UNDANG INFORMASI DAN TRANSAKSI ELEKTRONIK DALAM PENINDAKAN KEJAHATAN CYBERPORN ANAK MELALUI APLIKASI TELEGRAM DI INDONESIA

Abstract

Developments in information and communication technology have driven the increased use of the Telegram application as a digital communication medium. However, Telegram's high privacy features, large group capacity, and ease of file sharing also open up opportunities for abuse to spread child pornography (cyberporn). This study aims to analyze the effectiveness of the Electronic Information and Transactions Law (UU ITE) in combating child cyberporn crimes through the Telegram application in Indonesia and to identify obstacles faced in its enforcement. The research method used is normative legal research with a statutory and conceptual approach. Data was obtained through a literature review of laws and regulations, legal literature, and other relevant legal sources. The results indicate that the distribution of child pornography through Telegram is subject to the provisions of Article 27 paragraph (1) in conjunction with Article 45 paragraph (1) of Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions. The ITE Law serves as a lex specialis in handling cyberporn crimes because it specifically regulates the distribution and transmission of electronic information containing indecent content. However, effective law enforcement still faces various obstacles, such as the use of encryption, user anonymity, ease of digital data deletion, and limited electronic evidence. Therefore, it is necessary to strengthen the capacity of law enforcement officials, increase cooperation with digital platform providers, and optimize cyberspace surveillance to provide more effective protection for children from the threat of cyberporn crimes.
