TINJAUAN YURIDIS PEMBEBASAN BERSYARAT DAN PEMBERI REMISI DALAM REINTEGRASI SOSIAL NARAPIDANA
Abstract
Parole and remission are policies in the correctional system that have an important function in realizing the social reintegration of prisoners. This policy is not only administrative, but also has a strong juridical basis in guaranteeing the right of prisoners to return properly to society. This research aims to analyze the juridical review of the parole and remission policies in the framework of social reintegration of prisoners, identify the impact of their implementation after sentencing, and formulate legal solutions to optimize the effectiveness of these policies.
The rescearcher employs a normative juridical method. The normative juridical approach utilizes legal journals, legislation and conceptual frameworks, supported by secondary data analysis from literature, legal documents and relevant regulations. The results showed that juridically, parole and remission have a clear legal basis, among others in Law Number 12 of 1995 concerning Corrections and its implementing regulations. However, in its implementation, there are still various obstacles, such as discrepancies between norms and practices, lack of supervision, and the non-optimal role of the community in the reintegration process. As a result, some prisoners experience difficulties in re-adapting to the social environment. Therefore, holistic legal solutions are needed, such as harmonizing regulations, strengthening pre-release coaching, and increasing synergy between correctional institutions, correctional centers, and the community, so that the social reintegration process runs more effectively and sustainably.
